2017 Annual Meeting Minutes

Members present:

Three (3) homeowners submitted proxy votes to be used in their absence.

A quorum was met and the meeting called to order at 10:08am.

Introductions were made and new members were welcomed to the association.

The 2016 annual meeting minutes and financial report were read and approved.

Old Business:

Culvert at Beauty Bay Dr.: the culvert was replaced and is working effectively to divert water under Beauty Bay Drive.

Erosion Issues/Culverts and Ditches: it was determined that much of the erosion issues experienced in the neighborhood was a result of spring water runoff either not being diverted to a ditch or not being able to continue downhill in the ditch due to blocked culverts.  Homeowners are reminded it is the homeowner (and “lot only” owners) responsibility to ensure their ditch and culvert is clear of debris.  This is best done before the onset of winter.

Docks:

New dock bumpers were installed in fall 2016.  Everyone present at the 2017 annual meeting was pleased with the outcome.

Plexiglass was installed on either side of the dock gate to help avoid individuals from “swinging around” the gate to access the dock.

Keeping the dock gate locked is a recurring issue. It was approved at the Board of Directors meeting (August 18) to install “self-locking” locks.

New identification tags are to be produced and distributed to owners for use at the docks and common areas. 

Leaning Tree: The tree in question has been monitored over the past few months and determined to be sturdy enough to remain in place. The vote at the 2016 annual meeting to remove the “leaning tree” was rescinded at the 2017 annual meeting. The tree will remain in place for now.

Website: Barbara Christofferson has been working on a website for the HOA.  It is almost complete and should be available to homeowners later this year.  The website will have a BBHOA ‘member’s only’ access portion as well as an area for general information.  Information such as CC&Rs, By-Laws, meeting minutes and newsletters will be posted to the website.

New Business:

Beauty Bay HOA assessments increase from $145.00 to $165.00 per lot

Dock fees will remain the same for the coming year at $150.00 per boat slip.

Homeowners assigned a boat slip should be aware that the docks are in need of some major restoration to the submerged structure in the near future. The dock fee will not cover these costly repairs which could be upwards of $100,000.00 (upwards of $5,000.00 per person) for both docks. The actual cost will be determined when a formal estimate is accepted by the Board of Directors.  The cost to repair the submerged structure will be in the form of a special assessment to boat slip owners.  One of the dock piers is broken and will be replaced as soon as possible to avoid further damage to the dock structure.  

Road Committee: It was noted that one of the largest expenses for the HOA was related to road maintenance.  It was also noted that BBHOA does not have a formal road committee.  At the Board of Directors meeting (August 18) the board unanimously agreed to the formation of a road committee with responsibilities to include (1) arranging snow removal and sanding in winter, (2) dust control in summer, (3) reviewing erosion issues, ditches and culverts.  Joe Rush, Cory Bridges, Joe Bordelon and Fred Henkel volunteered to be on the road committee. 

It was proposed at the annual meeting that Scenic Bay Drive, Artesian Way and Ridgetop should also be included for snow removal and sanding in addition to Beauty Bay Drive to keep these roads open in winter.  It was recognized that some of these roads are in bad condition because of erosion and that our snow removal guy may not be able to plow them in their current condition.  The road committee will meet and report their findings to the Board of Directors. 

HOA Community Rules: it was noted that homeowners (and renters) have become relaxed about following HOA community rules.  These rules are in place for everyone to enjoy the quality of life provided here at Beauty Bay. Please be respectful of other homeowners and follow community rules.

Some individuals continue to drive too fast on Beauty Bay Drive.  A motion was made, seconded and approved to once again install speed bumps on Beauty Bay Drive to slow down traffic and help reduce dust.

Petition to change Beauty Bay Estate from “open range” to “herd district”: One of the homes adjacent to Beauty Bay Estate and out with our HOA has developed the property to house cattle and other livestock.  The livestock have been permitted to roam freely under Idaho’s “open range” policy causing damage and frustration for many homeowners.  BBHOA is working on a petition to change this area from an “open range” designation to a “herd district” where the owner will then be obligated to contain their livestock. 

Firesmart® Update: Beauty Bay Estates is becoming dense with fuel putting the area at risk for forest fire. Bill Braid made inquiries to the Kootenai Fire Department about the possibility of Beauty Bay receiving help under the Firesmart® program to thin out brush and trees to reduce fuels in the area. Unfortunately we were too late to receive a grant for 2017.  Bill will take the initial steps later this year to seek a grant from Firesmart® to work on reducing fuels in 2018.

Legal Business:

Beauty Bay Drive Easement:The Board of Directors are finalizing some legal issues from past litigation with Floyd Flowers associated with homeowner access to Beauty Bay Drive.

Beauty Bay Lakewater Users Association (BBLUA) Update: BBHOA Board of Directors and BBLUA have been working with an attorney on an easement for necessary water lines going through BBHOA property and release of liability.  The terms and language of the easement is almost finalized. BBHOA will recoup cost for attorney fees and insurance from BBLUA.

Report from Architectural Committee: the architectural committee (Bill Braid, Joe Rush and Ray Michelson) are working on recommendations for homeowners. 

Election of Board Members and Officers:

Two Board of Director positions were up for vacancy/re-election: Bill Braid and Barbara Christofferson agreed to retain position and were approved by the homeowners to serve another two year term.

Secretary/Treasurer was up for vacancy/re-election: Angela Brown agreed to retain position and was approved by the homeowners to serve another term.

A huge “Thank You” goes out to our volunteers for road work, dock work and everything in between and making Beauty Bay a nice place to live.  Thank you!!
